This Client Agreement is the main contract for the services DMA Capitals provides. It sits alongside our Terms & Conditions, Risk Warning and Anti Money Laundering policy, and should be read together with them.
01About this agreement
- This agreement is made between DMA Capitals Limited (the “Company”) and each person or entity who completes the registration form at dmacapitals.com (the “Client”).
- It sets out the relationship between us: how orders are executed, the rules that apply to your account, deposits and withdrawals, how disputes are handled, how we prevent fraud and how we communicate with you.
- The Company operates under the laws of Saint Lucia, and this agreement is governed by them. Disputes are resolved as set out below, through negotiation, mediation, arbitration or the courts of Saint Lucia.
- By accepting this agreement, you confirm that you are at least 18 years old and legally able to enter into a binding contract.
- This agreement is binding even though it is made online. Accepting it at a distance does not release you from any obligation in it.
02Definitions
The definitions in our Terms & Conditions apply here too. In addition:
- Access Data
- Your logins, passwords and client portal credentials.
- Ask / Bid
- The higher price, at which you buy, and the lower price, at which you sell.
- Automated Trading Software
- An Expert Advisor (EA) or any other program that places trades for you.
- Balance
- The total of your closed trades, deposits and withdrawals, not counting open positions.
- Free Margin
- Your Equity minus the margin in use: the funds available to open new positions.
- Margin Level
- Your Equity divided by the margin in use, shown as a percentage.
- Stop Out
- The Margin Level at which open positions start being closed automatically.
- Prohibited Software
- Any software built to exploit delays in prices or in the trading platform.
- Fraudulent Activity
- Deposits or trading funded by stolen cards or unauthorised payments, or built on latency arbitrage.
03Our services
- We receive, transmit and execute orders in spot forex and CFDs on indices, precious metals and commodities, on an execution-only basis. No underlying asset is ever physically delivered.
- We do not give personal financial advice or recommendations. Market commentary, newsletters and education are general information only.
- You must trade on your own behalf. Managing other people’s accounts is not allowed, except through our Copy Trading programme.
- Each client may hold one client portal. Opening several portals under different email addresses is not allowed, and duplicate portals may be closed.
04Orders and execution
Orders are passed straight to our liquidity providers, with no dealing desk in between. In fast markets, and around major news, an order may be filled at a different price from the one requested (slippage).
We may cancel orders, or void the profit on them, where they come from:
- arbitrage of any kind, including latency arbitrage;
- high-frequency trading that puts a load on our systems;
- prices clearly away from the market (off-market spikes);
- positions opened and closed within seconds for the sole purpose of generating Introducing Broker commission.
05Margin, stop out and negative balance
If your Margin Level falls to or below the Stop Out level, open positions are closed automatically, starting with the one making the largest loss, until the Margin Level is restored.
Negative balance protection: if a price gap closes positions at a level that leaves your Balance below zero, we reset it to zero. You will never owe us more than you deposited.
06Leverage
The maximum leverage on your account depends on your Equity:

From three hours before the market closes for the weekend or a major holiday, leverage may be reduced to 1:100 on all accounts. Positions left open over the close must have enough margin at the lower leverage.
07Prohibited actions
The following lead to immediate and permanent suspension of your account, and any profit made through them is cancelled:
- trying to reverse engineer or get around our security;
- using Prohibited Software, or AI tools built to manipulate prices or the platform;
- installing or spreading malware;
- abusive or threatening behaviour towards our staff.
08Account security and dormant accounts
- Keep your Access Data private. Anything done with it is treated as done by you.
- Tell us immediately if you think someone else has your Access Data.
- A trading account with no activity for 30 consecutive days and a balance under $10 may be archived.
- Accounts inactive for one year or more may be closed, in line with our data retention policy.
09Deposits and withdrawals
- Deposits and withdrawals must be made in your own name. Third-party payments are not accepted in either direction.
- Withdrawals are paid back through the same method you deposited with, in proportion to the amounts deposited through each method, as our anti money laundering rules require.
- Withdrawal requests are processed within 3 business days of approval. The time the money then takes to reach you depends on the payment method.
- Internal transfers are only allowed between accounts that belong to the same client.
If funds are deposited and then withdrawn without any trading, a 5% gateway fee and a 5% operational fee may be deducted from the amount withdrawn.
10Complaints and disputes
- A complaint about how an order was executed must reach us in writing within 24 hours of the event.
- Any other complaint must reach us within 30 calendar days of the event, at complaints@dmacapitals.com.
- Our server log files are the authoritative record for any dispute about order execution, and take precedence over any other record, including screenshots.

11Force majeure
We are not liable for trading losses caused by events beyond our reasonable control, including natural disasters, serious failures of communication networks, war and cyber attacks such as denial-of-service attacks.
12Copy Trading and strategy providers
- Strategy providers act independently and are not employees, agents or advisers of DMA Capitals.
- We do not guarantee the performance of any strategy. Choosing a strategy provider, and every result that follows from it, is at your own risk.
- A strategy provider’s track record is based on past trading, and does not guarantee future profit.
