By using this website or opening an account, you agree to these terms, which cover both the website and everything published on it. DMA Capitals Limited may update them at any time. Checking this page from time to time is your responsibility, and continuing to use the website after a change means you accept the updated terms.
These terms are written in English, and the English version governs. Where a translation differs from it, the English version applies.
Together with any schedules and the documents referred to in them, as amended from time to time, these terms (the “Agreement”) form the contract between you and us. Please read them carefully, and contact us before trading if anything is unclear.
DMA Capitals Limited operates the DMA Capitals brand and the website at dmacapitals.com, and offers trading in spot foreign exchange and contracts for difference (CFDs).
Funding an account does not by itself make you our client. We are only bound by this Agreement once we have confirmed to you that your account is open.
01Scope and commencement
- Scope
- This Agreement sets out how we provide our services to you, and governs every Transaction opened or still open between us from the date you accept it.
- Commencement
- This Agreement replaces any earlier agreement between us on the same subject and takes effect when you accept it through our website or client portal.
02Definitions
- Account
- A trading account you hold with DMA Capitals.
- Agreement
- These terms together with the documents you accept alongside them.
- Authorised Person
- Someone you have authorised in writing to give us instructions for your Account.
- Base Currency
- The currency your Account is held and reported in.
- CFD
- A contract for difference on forex, indices, precious metals, commodities or another underlying we offer.
- Client
- Any individual or legal entity we provide services to under this Agreement.
- Equity
- Your Account balance plus unrealised profit, or minus unrealised loss, on open positions.
- Financial Instrument
- Spot foreign exchange and the CFDs available on our platforms.
- Introducing Broker (IB)
- An independent person or company paid by us for referring clients.
- Margin
- The funds needed in your Account to open and keep a leveraged position.
- Margin Call
- The point at which Equity is no longer enough to support open positions, and positions may be closed.
- Spread
- The difference between the bid and the ask price of an instrument.
- Trading Platform
- MetaTrader 5, the DMA Capitals Web Trader, Copy Trading and any other system we provide for trading.
- Transaction
- Any trade, deposit, withdrawal or transfer made on your Account.
03Our services
We receive and transmit your orders in Financial Instruments and execute them through our Trading Platforms. We also provide the currency conversion that goes with those services.
Our services do not include investment advice. In particular:
- Nothing we say or publish is a personal recommendation, and no advisory relationship is created between us.
- Market commentary, education and analysis on our website are general, and do not take your objectives or circumstances into account.
- Every trading decision, and every strategy you follow, including through Copy Trading, is yours alone.
04Margin trading and leverage
Forex and CFDs are traded on margin. You must hold enough margin in your Account before opening a position, and keep enough to support it while it is open. Leverage of up to 1:500 may be available depending on the instrument and your account type.
If your Equity falls below the required level, our systems may close some or all of your open positions automatically, without further notice. We may change margin requirements and leverage at any time, including while positions are open, particularly around major news, weekends and market holidays.
05Risk acknowledgement
Trading leveraged products is highly speculative and carries a high level of risk. We do not guarantee the value of your capital at any time, and you may lose all of the money you deposit. Please read our Risk Warning before you trade.
06Your account
You open an account online. Before you can trade or withdraw, we will ask for proof of identity (a valid passport or national ID card) and proof of address (a utility bill or bank statement dated within the last 3 months).
- Your Account is for trading only and must not be used to make or receive payments to or from third parties.
- Where you hold more than one Account with us, we may treat them as one for set-off and for negative balance purposes.
- You must keep your personal details up to date and tell us promptly when anything changes.
07Client categorisation
We treat each client as a retail client unless we agree in writing to treat them as a professional client or an eligible counterparty. The category decides the level of protection that applies to you, and you may ask to be re-categorised at any time.
08Your obligations
- You understand the markets you trade and the way Forex and CFDs work.
- You take full responsibility for every order placed on your Account.
- You are responsible for your own devices, internet connection and platform settings.
- You monitor your open positions and margin level yourself, at all times.
09Interest
No interest is paid on money held in your Account. You waive any claim to interest earned on the accounts where client money is held.
10Fees and charges
You pay the spreads, commissions, swaps and taxes that apply to your trades, as published on our website and in the Trading Platform. We may also debit reasonable costs for services beyond the ordinary, such as paper statements or manual processing.
11Introducing brokers and inducements
We may pay commissions or rebates to Introducing Brokers who refer clients to us. Introducing Brokers are independent of DMA Capitals, are not our agents, and cannot bind us or make promises on our behalf.
12Communication and orders
We send notices electronically, through the Trading Platform, the client portal or by email, and always in English. Orders you place through the Trading Platform, or that we accept by email or telephone, are binding on you.
We may refuse or cancel an order, or reverse a trade, where it involves:
- an abuse of our systems, such as latency or price-feed arbitrage, or an Expert Advisor built to exploit delays;
- market manipulation, insider information or any other unlawful practice;
- a price that was clearly wrong at the time of execution;
- anything that interferes with the normal running of the Trading Platform.
13Deposits, withdrawals and client money
- Deposits must come from, and withdrawals are paid only to, an account in your own name. Third-party payments are not accepted.
- Withdrawal requests are processed within 3 business days of approval. How long the money then takes to reach you depends on the payment method.
- Client money is held in segregated accounts, kept separate from the funds DMA Capitals uses to run its business.
14Operational and legal provisions
- Execution complaints
- A complaint about how an order was executed must reach us in writing within 24 hours of the event. For every other complaint, see our Complaints page.
- Systems and security
- You accept the risks of trading online, including viruses, hardware faults, connection delays and unauthorised access. Keep your login details private. Anything done with them is treated as done by you.
- Recording
- Telephone calls and chat conversations with us may be recorded, and those records may be used as evidence in a dispute.
- Outsourcing
- We may appoint specialist providers for hosting, servers, platform technology and other services, and stay responsible for how they are used on your behalf.
- Set-off
- We may use money in any of your Accounts to settle an amount you owe us on another.
15Changes, termination and governing law
- Changes
- We may change this Agreement by publishing the new version on our website or by telling you by email. The change applies from the date shown.
- Termination
- You may end this Agreement by giving us 7 business days’ written notice. We may end it by notice to you. Open positions are closed, and any amount still owed must be settled, before the Account is closed.
- Governing law
- This Agreement is governed by the laws of Saint Lucia, and the courts of Saint Lucia have jurisdiction over any dispute arising from it.
16Your declaration
By accepting these terms, you confirm that:
- you are at least 18 years old and legally able to enter into a binding agreement;
- you are not a resident of a country where we do not offer our services;
- you have read and accept this Agreement and our Risk Warning in full;
- everything you have told us in your application is true, accurate and complete.
